General Terms and Conditions
These terms and conditions apply to all business relations initiated or completed on www.viplounge.ch, between the seller and its customers from Switzerland. The seller is the VipLounge GmbH, headquartered in Cham (Switzerland). The valid version of the contract terms and condition at the moment of purchase is exclusively applicable. Any other terms and conditions of the customer will not be accepted by the seller.
Territorial scope of the offer, prices and ordering
2.1. All prices are in Swiss francs including VAT and without delivery. Home delivery and pickup costs are not included and must be paid separately.
2.2. Price changes and pricing errors are reserved.
2.3. The offer of ww.viplounge.ch (like furniture, etc.) can exclusively be ordered online via eshop. All personal information regarding the order has to be valid and true. The client accepts the terms and conditions by sending the order.
2.4. The order is final. The seller confirms the purchase by e-mail.
Delivery Conditions
3.1. The ordered goods can be picked up as soon as possible, usually within 7-10 working days, as long as the item is available. Delivery of goods takes place only after received payment.
3.2. The customer must order additional service like home delivery or pickup. The ordered goods will be delivered as quickly as possible, usually within 7-10 working days, to the address provided, subject to receipt of the payment. The scheduling of the delivery date will demand flexibility from both sides - buyers and seller.
3.3. The seller is entitled to partial deliveries.
3.4. If a product cannot be delivered within the deadline set in points 3.1 and 3.2 above, the customer will be informed immediately. If the delay is longer than 14 working days, the customer has the right to cancel the contract within 5 days after notification. This does not apply to products for which the catalog of www.viplounge.ch mentions explicitly a longer delivery time.
3.5. The home delivery costs include the cost of home delivery of the purchased item to the provided address in the order confirmation. The delivery requires a suitable road for a truck up to the unloading point.
3.6. Any risk and benefit in regards to the purchased goods merge to the customer once the good is picked up or send out for delivery. The customer is free to buy transportation insurance.
Terms of payment
4.1. The price for the purchase and any other services required, like home delivery and pickup costs, are due immediately once received the order confirmation in case of a payment by credit card. Cash payment is due on delivery or pickup.
4.2. Payment must be made only with Master Card or Visa before the items are picked up or send out by the Seller. Cash payment is due upon delivery or pickup.
4.3. Only the card holder or a person entitles to their use can make the payment via credit card.
4.4. All invoiced amounts are payable in Swiss Francs.
4.5. In the event of default, the client is also obligated to pay a delay interest of 5% per annum. In addition, the seller can charge a late payment supplement in the amount of20 Swiss Francs. Any further claims especially for the judicial enforcement of the due amount will be enforced without notice.
Retention of title
5.1. Ownership of the goods will remain with the seller until payment of all invoiced amounts is received. Furthermore the seller is entitled to list his entitlement in the according retention registry and, in case of default of the contract, to recover the goods.

Warranty and liability
6.1. For all objects of sale, the warranty period is 12 months from date of order, unless a different warranty period has been agreed.
6.2. The customer is obliged to check immediately and carefully the goods upon receipt and notify with no delay to the seller any defects in writing. Otherwise any warranty claim on property will be denied as stated in point 6.4.
6.3. Any alteration of the purchased good due to a natural aging process is not considered defects and excluded from the warranty. The warranty also does not cover any alterations in natural products such as wood and leather, which lie within the range of natural colors, structures and other differences. Furthermore the warranty is not extended to any deviation of the items purchased from the appearance and look of the respective photos on www.viplounge.ch.
6.4. The customer has an exclusive right to repair, but not on replacement (conversion) or price reduction of the defective goods. The seller not only reserves the right to review the item in question immediately but also to decide whether the item will be repaired or out of goodwill replaced with a defect-free item. The customer looses the right to demand amendment of the item in question in case of any repair that has been done without the written consent of the seller. Moreover the item should not be installed in case any defect is detected.
6.5. Any further claims for damages are explicitly excluded in line with the Swiss law. In particular, the seller is not liable for any damages caused by natural abrasion or improper use as well as damages not caused directly to the delivered goods. Furthermore the seller does not accept any liability for lost profits or indirect or direct losses, which may arise to the customer or a third party.
Right of return and cancellation of the contract
7.1. The return of items with no damages is not permitted. A right of return is only allowed in case of wrongly delivered goods. The seller reserves all rights in case of changes in design or in technical areas which do not affect the function and quality of the item in question.
7.2. In the event that an item is not available or can’t be delivered, the seller has the right to cancel the contract without offering any compensation.
Privacy Policy
8.1. The customer agrees that all personal data for order and delivery, billing, accounting and other internal applications are stored and processed. This information is not shared with third parties unless it is necessary for the contract.
Intellectual property
9.1. All images, graphics and other content and design of www.viplounge.ch are protected by copyright. Reproduction, copy or print the web pages of the web shop www.viplounge.ch are allowed only in connection with the order. Any further mean of processing, copying, distribution or other ways of reproduction are prohibited.
Jurisdiction
10.1. All contracts concluded with the seller are subject exclusively to Swiss law. The applicability of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 is hereby explicitly excluded.
10.2. Jurisdiction for disputes arising under the contract is Cham, unless mandatory legal provisions indicate the contrary.
